Results of LPAT hearing

Below please find the ruling of the LPAT regarding the appeal filed by the owners, Barbara Rowland, Keith Ball and Gayle Gailits, against the Town of Huntsville Council ruling on Treasure Island. As you will read, the Tribunal adjudicator sided with the owners and gave them what they wanted. This is very discouraging for the LWRA as well as the Friends of Treasure Island.


In summary, the zoning, for all of Treasure Island, will be changed from “conservation holding’ to “shoreline residential’ and one dwelling can be built on each lot, (the whole island is currently two lots). In addition, the transfer point/boat launch on North Waseosa has been approved on Keith Ball’s property.


The approval for one cottage per existing lot is not our main concern. In fact, we offered that concession, to the owners, early in the process. They outright rejected our proposal which would have seen the balance of the island, beyond the two cottage ‘envelop’ remain conservation land. What is worrisome is the future. When the island is sold, it is possible the new owner/developer will attempt to further subdivide the largest of the two lots and create multiple additional lots. We suggest you read about Sugarloaf Island on Lake Joseph, posted on the LWRA website. We do not want this to happen to Lake Waseosa.

We remind the membership that we were put in the position of having to defend the conservation zoning and the Town of Huntsville rejection of the owner’s application when the town decided they did not have the ‘resources’ to defend their own decision at the Local Planning Appeals Tribunal.


We thank you for your support that allowed us the opportunity to represent Lake Waseosa at the LPAT hearing. We still have a shortfall of approx. $5,000 needed to cover the professional fees incurred and would greatly appreciate further contributions.
